Exempt Development

Many minor and low-impact works don’t need development or construction approval, find out if your development is exempt from council approval.

Many minor and low-impact works don’t need development or construction approval, as long as they fully comply with the exempt development standards as set out by the State Environmental Planning Policy (Exempt and Complying Development Codes) 2008.

For minor works and/or maintenance affecting a Heritage Item or Heritage Conservation that may not meet the requirements for exempt development, an application under the Albury Local Environment Plan 2010 clause 5.10(3) may be made to Council for approval of the works.  To submit a minor works application, complete the form and email required documentation to info@alburycity.nsw.gov.au.

As the land owner, it’s your responsibility to determine if your development meets these standards. To find out if your development is exempt from council approval or for more information, head to the NSW Government’s Planning Portal.

It’s important to be aware that although your building works may not need a development or construction approval from us, they may involve work that requires other types of approval. For example, if you’re undertaking plumbing works, you may need to apply for a plumbing approval.
